Patterns, Ltd. operates a community of artist studios in the Bayview and Hunter’s Point districts of San Francisco, California, commonly known as The Point (“The Point,” “we,” “our,” or “us”).  This Privacy Policy describes the practices regarding The Point’s collection and use of personally identifiable information (“Personal Information”) via The Point’s website, www.thepointart.com (the “Website”), as well as Personal Information collected offline by The Point.  Except as set forth in this Privacy Policy, The Point will not share, sell, or rent individual Personal Information with anyone without your advance permission or unless ordered by a court of law.

What Information We Collect

1. Personal Information Provided by You

We collect certain Personal Information that is voluntarily provided by you in order for us to deliver the services.  For example, you may be asked to provide your name, email address, and phone number, when requesting to rent a studio at the Point, or to be placed on the waitlist for The Point.  If you do not provide us with this Personal Information, we may not be able to assist you.  We may collect your email address so that we can send you updates and information that you request. We may use your email address to inform you about current events or to send you updates regarding information that was previously sent to you.

2. Automatically Collected Non-Personally Identifiable Information

When you visit our Website, we may automatically collect information that will help up administer the Website and analyze its usage. Examples of the type of information that is automatically collected includes (a) your IP address, (b) your device ID, (c) the name of your Internet service provider, (d) your browser information, and (e) the date and time you access the Website.  We collect this information because it helps us administer and operate the Website and better understand how users interact with and access the Website.

We collect and use your Personal Information for business purposes, such processing transactions that you have requested (e.g., a request to rent a studio), communicating with you regarding the status of an inquiry or application, responding to your questions, or fulfilling other purposes disclosed at the time you provide your Personal Information.

We may use the contact information you provide to communicate with you through email and other means, including telephone calls. If you provide your telephone number, you agree that we may contact that number even if it is registered on a corporate, state, or national Do Not Call Registry.

2. Sharing with Third Parties

We may share your Personal Information with third-parties who perform services on our behalf.  This includes, without limitation, third-parties that send communications, process payments, assist renter's insurance, provide credit checks, or collection services, provide property management services to The Point, including to provide customer service on our behalf. 3. Affiliated and Subsidiary Companies

We may share Personal Information with our affiliated or subsidiary companies who use Personal Information for business purposes related to your tenancy or to process any application, request, inquiry, or other information or Personal Information you submit via the Website.

How We Respond to Do Not Track Signals

We do not respond to Do Not Track signals. However, some third-party websites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such websites, your web browser allows you to set the DNT signal within the browser so that third-parties (particularly advertisers) know you do not want to be tracked.

By providing an email address on the Website, you agree that we may contact you in the event of a change in this Privacy Policy or to provide you with any service-related notices.

You may update or correct information about yourself by making changes to your profile by emailing us at contact@thepointart.com.  If you completely delete all such information, then your account may become deactivated.  We may retain an archived copy of your records as required by law, to comply with our legal obligations, to resolve disputes, to enforce our agreements or for other legitimate business purposes.  

We may contact you to request that you update your Personal Information on a regular basis to ensure its integrity for the purposes of ongoing data management.

To opt out of sharing your Personal Information with third-parties for their direct marketing purposes, please email The Point at contact@thepointart.com and clearly state your request, including your name, mailing address, email address and phone number.  Please see the “Your Choices” section of this Privacy Policy for additional information.

In addition, California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
